These terms govern your use of the geniusofand.com website and the GeniusOfAnd service, including our text messages (together, the “Service”), provided by Genius of And, LLC (“GeniusOfAnd”, “we”, “us”). By using the Service you agree to these terms and to our Privacy Policy.
The Service
GeniusOfAnd helps households plan meals, organize recipes and grocery lists, and coordinate grocery shopping for pickup or delivery, with help from your “Genius Team”: conversations are handled by automated systems and by GeniusOfAnd team members. Features may change over time.
Eligibility and your account
You must be at least 18 years old and located in the United States to use the Service. You are responsible for the information you give us, including making sure any phone number you use is yours.
Text messaging terms
By opting in, you agree to receive recurring text messages from GeniusOfAnd at the mobile number you provide.
- How to opt in: text JOIN to our toll-free number (listed here once the program is live). See Text messages.
- What we send: account and service messages — conversations with your Genius Team, delegating tasks to your Genius Team, grocery-day confirmations, order updates and account notices. We do not send marketing or promotional text messages under this program.
- How often: message frequency varies with how you use the Service — typically a few messages a week, more during an active conversation.
- Cost: Msg & data rates may apply. Check your mobile plan for details.
- To stop: reply STOP at any time. We will send one message confirming you are unsubscribed and no further messages unless you opt in again by texting JOIN.

- Consent is not a condition of purchase.
- Carriers are not liable for delayed or undelivered messages.
- Privacy: we do not sell, rent or share your mobile phone number or text-message consent with third parties or affiliates for their marketing purposes. See our Privacy Policy.
Acceptable use
Do not use the Service to break the law, to send messages that are abusive, harassing or fraudulent, to interfere with the Service, or to use someone else’s phone number or account without permission.
Groceries, orders and fees
When we place a grocery order for you, for pickup or delivery, the products are sold by third-party retailers and are picked up from the retailer or delivered by the retailer or a third-party delivery service, under their terms. We tell you the costs and any fees before an order is placed.
Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. Meal ideas and recipes are suggestions; you are responsible for checking ingredients for allergies and dietary needs.
Limitation of liability
To the extent permitted by law, GeniusOfAnd is not liable for indirect, incidental, special or consequential damages, and our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim.
Changes and termination
We may update these terms; we will post the new version on this page with a new effective date. You may stop using the Service at any time, and we may suspend or end access for anyone who breaks these terms.
Governing law
These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules.
